Wills

Ensuring your estate and assets are bequeathed in line with your wishes.

Formalising the way in which you want your assets to be passed on when you die is important, if you want this to be done as effectively as possible and according to your wishes.

If you die without a will, this can cause a variety of problems, particularly if you are not married or in a registered partnership.  The English rules of intestacy do not recognise the concept of the common law spouse.

So, if you want your assets to pass onto your partner, and you are not married, you need a will.

Also, the English intestacy rules do not always pass everything to your spouse. If you have children then your estate may be divided between your spouse and your children, potentially giving rise to an immediate charge to inheritance tax. That tax charge can be removed with a simple will in favour of your spouse.

These are just some of the reasons why it is important to have a will in place.

We also have a specialist team that can advise on Sharia compliant wills.

How we help

We will take time to understand you, your family and your assets, as well as what you want to achieve, so that we can prepare your new will and associated documents, to deliver on your wishes.

By building an understanding of your finances and family circumstances in this way, we can signpost potential challenges you may not have considered, and ensure that your will is drafted in the most efficient way to avoid potential disputes further down the line.

Key considerations might include thinking about dependants, guardians and executors, any children or grandchildren, the marital status of your children and how this could impact what you wish to bequeath, potential foreign assets you hold, house ownership – (both in the UK and abroad), as well as your domicile status and the potential impact on inheritance tax.
