Business Interuption Insurance Test Case Appeal
The FCA filed an application to appeal to the Supreme Court to achieve clarity on affected BI policies at speed on the proper application of the COVID related Business Interruption judgment handed down on 15 September. This ‘leapfrog’ application has been filed on a precautionary basis in the event that full agreement with the eight insurer defendants is not reached by close of business this Wednesday, 7th October.
